The seminar was chaired by Joe Finnerty, a social policy analyst, School of Applied Social Studies, University College Cork, Republic of Ireland. Professor Peter Herrmann (a researcher of CSU Human Rights Center), Mehmet Okyayuz (a professor of political science at Middle East Technical University, Turkey), Associate Professor Li Juan (a researcher of CSU Human Rights Center), Wang Huiru (the Assistant Researcher, Institute of International Law of Chinese Academy of Social Sciences) and Lecturer F\u00e9ilim \u00d3 Hadhmaill (School of Applied Social Studies, University College Cork, Republic of Ireland) participated in the discussion, and they shared, reported and supplemented some corresponding views. This seminar centered on Eco-environmental protection and animal rights. It explored that society and humans are faced with tests today, with the development of digitalization and artificial intelligence challenging the independence and specificity of humans. And nature and its perceptions are also contributing to the threats faced by human beings, so humans should seek appropriate answers to this challenge from the perspective of legal and professional knowledge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prof. Peter Herrmann firstly cited Copernicus\u2019s theory of heliocentrism and used the Earth\u2019s place in the universe as an example to illustrate that the notion of human exceptionalism is in fact a cognitive bias. He further pointed out that Darwin\u2019s \u201cevolution\u201d and Freud\u2019s core ideas pose fundamental challenges to human superiority. Despite the current heyday of artificial intelligence and digitization, such superiority remains illusory. In his discussion of legal systems and social rights, Prof. Peter Herrmann emphasized that when the current legal system focuses too much on individual rights but ignores broader notions of social rights, it may lead to a loss of human understanding of the broader context in the pursuit of specialization and detail. He referred to the impact of computational errors and digitization on spatial perception and the possible limitations of human perception of these concepts. Finally, Prof. Peter Herrmann called for an increased focus on general issues, moving beyond individualism and detail to revisit current values and legal systems in order to respond more comprehensively to the challenges of contemporary society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prof. Mehmet Okyayuz presented his view on the need to avoid excessive attention to detail and neglect the broad complexity of events when law is used to analyze social events. He argued that law should not only understand the broader context of the social sciences, but also maintain its normative character, and emphasized the importance of generalized thinking and abstract reflection. He noted that with the rise of social sciences in the 19th century, law began to integrate social dynamics more deeply in an attempt to build a framework understanding of the legal environment. However, in this process, the normative nature of law was being marginalized. In addition, Professor Mehmet Okyayuz criticized the attempts of some legal scholars to bring the social context to the fore, blur the line between private and public events and thus ignore the individual\u2019s right to privacy. He advocated for deeper reflection on the relationship between the social sciences and the legal sciences and approved the two to remain holistically linked. He argued that an in-depth exploration of the extent to which anthropocentrism is rejected is necessary, as this notion not only reflects human arrogance, but is also closely related to issues such as social struggles. Finally, Prof. Mehmet Okyayuz explored how law should deal with new forms of social activity. He argued that law should both clarify its position within the new social paradigm and adapt to the challenges posed by globalization in order to increase its resilience and effectiveness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Associate Professor Lai Juan echoed the views of Prof. Peter Herrmann. She argued that the traditional human-centered view of society had to be reinterpreted in the context of the \u201ccapital world\u201d in view of the intertwined impacts of capitalism, technology and environmental degradation. Moreover, she pointed out that&nbsp; current political and legal structures are not adequate to deal with the complex issues in this context. Therefore, Associate Professor Lijuan further discussed whether civil disobedience as a form of resistance can be effectively applied in the context of the legal and political crisis triggered by AI. She emphasized the importance of recognizing the unique complexity that AI brings to the legal and political environment. The nature of \u201ccivil disobedience\u201d as a solution is rooted in the ability to mobilize public support and pressure authorities to implement change. However, the technical complexity of AI systems may make it difficult for the public to fully understand relevant issues, thus limiting the effectiveness of civil disobedience strategies. In addition, because AI technology and its impacts transcend national boundaries, coordinated international efforts may be necessary to effectively address legal and political challenges, adding complexity to the development of AI at the international level as well. As a result, she argued that the applicability of civil disobedience in response to AI-induced crises is unclear and may require more nuanced and technical solutions. Advocating for the development of ethical AI frameworks, transparent algorithms and accountable AI governance structures is a more constructive approach when engaging with the technical aspects of AI. In addition, given the unique nature of AI and digitization, a multifaceted approach should be taken, leveraging the strengths of various stakeholders to collectively address the legal and political challenges posed by this transformative technology, in order to create robust legal and ethical infrastructures that can keep pace with the development of AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his response, Professor Peter Herrmann firstly described the nature of civil disobedience and stated that it was not a solution, but rather a way of demonstrating the unfulfilled existence of a society. He then emphasized the importance of considering the conflict between individual and public interests in the law-making process. He suggested that we should understand law from a broader social perspective, rather than limiting ourselves to the analysis of individual cases. In addition, Prof. Peter Herrmann explored the relationship between human society and the natural world, advocating the building of bridges between the two, rather than considering humans as beings outside of nature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the question of the role and limitations of law, Wang Huiru, Assistant Researcher at the Institute of International Law of the Chinese Academy of Social Sciences, took the limitations of human rationality as a starting point and emphasized that humans are not the masters of nature or the world, but rather one of its components. She argued that in the process of exploring natural order, humans inevitably make mistakes stemming from their inherent short-sightedness. Although law plays a role from different perspectives, it is not an all-purpose solution. She further referred to the role of international law in solving international judicial disputes and the complex interaction between international law and domestic law. While international law norms embody good moral values, their practical implementation is slightly insufficient. Finally, Wang Huiru noted that given the limited nature of human rationality, problems cannot be avoided as long as human beings exist. Therefore, we should constantly upgrade our level of rationality in order to better solve problems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lecturer F\u00e9ilim \u00d3 Hadhmaill (School of Applied Social Studies, University College Cork, Republic of Ireland) believed that law is mainly made by the ruling class to safeguard its interests and may change with the involvement of different power groups. He emphasized that the implementation of law requires coercive force, but not all law should be universally enforced, and that certain law may be enforced only in specific circumstances and for specific groups. He also mentioned that the implementation of law also requires certain degree of social consensus or consent. He illustrated this point by comparing law\u2019s differences in different countries, such as the different attitudes towards women wearing headscarves in Ireland and France. In addition, in the development of international human rights law, the focus of rights protection has shifted from individual rights to collective, social and economic rights. He criticized the issue of political involvement in the development of international law and illustrated the double standards and self-contradictions of the West on human rights issues with examples from real-life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Professor Peter Herrmann further explored the role and limitations of law in solving problems that arise in the context of globalization, such as migration. He argued that law needs to adapt to these new challenges and provide a binding solution. In addition, Prof. Peter Herrmann expressed his thoughts on the role of law in social progress by discussing the development of productivity and changes in economic patterns. He proposed that law should evolve with the times, reflecting and contributing to economic and social development, and not just remain at the level of solving traditional or superficial problems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the end of the seminar, Joe Finnerty concluded that although individual human beings may tend to think rationally, social processes may not be directly influenced by individual rationality and not always centered on human rationality, but have their own dynamics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2024\u5e745\u670831\u65e5\uff0cHRUG\u5b9a\u671f\u7814\u8ba8\u4f1a\u4e4b\u201c\u8bba\u6cd5\u5f8b\u3001\u4e13\u4e1a\u77e5\u8bc6\u4e0e\u610f\u89c1\u56de\u5e94\u5904\u4e8e\u5371\u673a\u4e2d\u7684\u793e\u4f1a\u548c\u4eba\u7c7b\u7684\u4ef7\u503c\u201d\u4e3b\u9898\u4f1a\u8bae\u987a\u5229\u53ec\u5f00\u3002\u672c\u6b21\u4f1a\u8bae\u7531\u7231\u5c14\u5170\u56fd\u7acb\u79d1\u514b\u5927\u5b66\u5e94\u7528\u793e\u4f1a\u7814\u7a76\u5b66\u9662\u653f\u7b56\u5206\u6790\u5bb6Joe Finnerty\u4e3b\u6301\uff0c\u4e2d\u5357\u5927\u5b66\u4eba\u6743\u7814\u7a76\u4e2d\u5fc3\u7814\u7a76\u5458Peter Herrmann\u6559\u6388\u3001\u571f\u8033\u5176\u4e2d\u4e1c\u79d1\u6280\u5927\u5b66\u653f\u6cbb\u5b66Mehmet Okyayuz\u6559\u6388\u3001\u4e2d\u5357\u5927\u5b66\u4eba\u6743\u7814\u7a76\u4e2d\u5fc3\u7814\u7a76\u5458\u9ece\u5a1f\u526f\u6559\u6388\u3001\u4e2d\u56fd\u793e\u4f1a\u79d1\u5b66\u9662\u56fd\u9645\u6cd5\u7814\u7a76\u6240\u52a9\u7406\u7814\u7a76\u5458\u738b\u60e0\u8339\u3001\u7231\u5c14\u5170\u56fd\u7acb\u79d1\u514b\u5927\u5b66\u5e94\u7528\u793e\u4f1a\u7814\u7a76\u5b66\u9662\u8bb2\u5e08F\u00e9ilim \u00d3 Hadhmaill\u53c2\u52a0\u8ba8\u8bba\u5e76\u8fdb\u884c\u76f8\u5e94\u89c2\u70b9\u7684\u5206\u4eab\u3001\u6c47\u62a5\u548c\u8865\u5145\u3002\u672c\u6b21\u8ba8\u8bba\u4e3b\u8981\u63a2\u8ba8\u4e86\u5f53\u4eca\u793e\u4f1a\u548c\u4eba\u7c7b\u6b63\u9762\u4e34\u7740\u8003\u9a8c\uff0c\u6570\u5b57\u5316\u548c\u4eba\u5de5\u667a\u80fd\u7684\u53d1\u5c55\u6311\u6218\u4e86\u4eba\u7c7b\u7684\u72ec\u7acb\u6027\u548c\u7279\u6b8a\u6027\uff0c\u800c\u81ea\u7136\u53ca\u5176\u611f\u77e5\u540c\u6837\u4f7f\u4eba\u7c7b\u9762\u4e34\u5a01\u80c1\uff0c\u4eba\u7c7b\u5e94\u5f53\u5982\u4f55\u4ece\u6cd5\u5f8b\u3001\u4e13\u4e1a\u77e5\u8bc6\u7684\u89c6\u89d2\uff0c\u5bfb\u6c42\u5230\u5e94\u5bf9\u8fd9\u4e00\u6311\u6218\u7684\u9002\u5f53\u7b54\u6848\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Peter Herrmann\u6559\u6388\u9996\u5148\u5f15\u7528\u4e86\u54e5\u767d\u5c3c\u201c\u65e5\u5fc3\u8bf4\u201d\u7406\u8bba\uff0c\u4ee5\u5730\u7403\u5728\u5b87\u5b99\u4e2d\u7684\u5730\u4f4d\u4e3a\u4f8b\uff0c\u9610\u660e\u4e86\u4eba\u7c7b\u7279\u6b8a\u6027\u7684\u89c2\u5ff5\u5b9e\u9645\u4e0a\u662f\u4e00\u79cd\u8ba4\u77e5\u504f\u5dee\u3002\u4ed6\u8fdb\u4e00\u6b65\u6307\u51fa\uff0c\u8fbe\u5c14\u6587\u201c\u8fdb\u5316\u8bba\u201d\u4e0e\u5f17\u6d1b\u4f0a\u5fb7\u7684\u6838\u5fc3\u601d\u60f3\u5bf9\u4eba\u7c7b\u7684\u4f18\u8d8a\u6027\u63d0\u51fa\u4e86\u6839\u672c\u6027\u7684\u6311\u6218\u3002\u4ed6\u63d0\u5230\uff0c\u5c3d\u7ba1\u4eba\u7c7b\u5f53\u524d\u5904\u4e8e\u4eba\u5de5\u667a\u80fd\u548c\u6570\u5b57\u5316\u7684\u9f0e\u76db\u65f6\u671f\uff0c\u4f46\u8fd9\u79cd\u4f18\u8d8a\u6027\u4ecd\u7136\u662f\u865a\u5e7b\u7684\u3002\u5728\u5bf9\u6cd5\u5f8b\u4f53\u7cfb\u548c\u793e\u4f1a\u6743\u5229\u7684\u8ba8\u8bba\u4e2d\uff0cPeter Herrmann\u6559\u6388\u5f3a\u8c03\u4e86\u5f53\u73b0\u884c\u6cd5\u5f8b\u4f53\u7cfb\u8fc7\u4e8e\u4fa7\u91cd\u4e2a\u4f53\u6743\u5229\uff0c\u800c\u5ffd\u89c6\u4e86\u66f4\u4e3a\u5e7f\u6cdb\u7684\u793e\u4f1a\u6743\u5229\u6982\u5ff5\uff0c\u53ef\u80fd\u5bfc\u81f4\u5728\u8ffd\u6c42\u4e13\u4e1a\u5316\u548c\u7ec6\u8282\u7684\u8fc7\u7a0b\u4e2d\uff0c\u4eba\u7c7b\u4e27\u5931\u4e86\u5bf9\u66f4\u5e7f\u9614\u80cc\u666f\u7684\u7406\u89e3\u3002\u4ed6\u63d0\u5230\u4e86\u8ba1\u7b97\u9519\u8bef\u548c\u6570\u5b57\u5316\u5bf9\u7a7a\u95f4\u611f\u77e5\u7684\u5f71\u54cd\uff0c\u4ee5\u53ca\u4eba\u7c7b\u5bf9\u8fd9\u4e9b\u6982\u5ff5\u7684\u8ba4\u77e5\u53ef\u80fd\u5b58\u5728\u5c40\u9650\u6027\u3002\u6700\u540e\uff0cPeter Herrmann\u6559\u6388\u547c\u5401\uff0c\u6211\u4eec\u5e94\u5f53\u589e\u5f3a\u5bf9\u4e00\u822c\u6027\u95ee\u9898\u7684\u5173\u6ce8\uff0c\u8d85\u8d8a\u4e2a\u4eba\u4e3b\u4e49\u548c\u7ec6\u8282\u7684\u675f\u7f1a\uff0c\u91cd\u65b0\u5ba1\u89c6\u5f53\u524d\u7684\u4ef7\u503c\u89c2\u548c\u6cd5\u5f8b\u4f53\u7cfb\uff0c\u4ee5\u4fbf\u66f4\u5168\u9762\u5730\u5e94\u5bf9\u5f53\u4ee3\u793e\u4f1a\u7684\u6311\u6218\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mehmet Okyayuz\u6559\u6388\u63d0\u51fa\u4e86\u5173\u4e8e\u6cd5\u5f8b\u5728\u5206\u6790\u793e\u4f1a\u4e8b\u4ef6\u65f6\uff0c\u5e94\u907f\u514d\u8fc7\u5ea6\u5173\u6ce8\u7ec6\u8282\uff0c\u5ffd\u7565\u4e8b\u4ef6\u7684\u5e7f\u6cdb\u590d\u6742\u6027\u7684\u89c2\u70b9\u3002\u4ed6\u8ba4\u4e3a\uff0c\u6cd5\u5f8b\u4e0d\u4ec5\u8981\u7406\u89e3\u793e\u4f1a\u79d1\u5b66\u7684\u5e7f\u6cdb\u80cc\u666f\uff0c\u8fd8\u5e94\u5f53\u4fdd\u6301\u5176\u89c4\u8303\u6027\u7279\u5f81\uff0c\u5e76\u5f3a\u8c03\u6982\u62ec\u6027\u601d\u7ef4\u548c\u62bd\u8c61\u601d\u8003\u7684\u91cd\u8981\u6027\u3002\u4ed6\u6307\u51fa\uff0c\u968f\u7740\u5341\u4e5d\u4e16\u7eaa\u793e\u4f1a\u79d1\u5b66\u7684\u5174\u8d77\uff0c\u6cd5\u5f8b\u5f00\u59cb\u66f4\u6df1\u5165\u5730\u7ed3\u5408\u793e\u4f1a\u52a8\u6001\uff0c\u8bd5\u56fe\u5efa\u7acb\u8d77\u5bf9\u6cd5\u5f8b\u73af\u5883\u7684\u6846\u67b6\u6027\u7406\u89e3\u3002\u4f46\u5728\u8fd9\u4e00\u8fc7\u7a0b\u4e2d\uff0c\u6cd5\u5f8b\u7684\u89c4\u8303\u6027\u6b63\u5728\u88ab\u8fb9\u7f18\u5316\u3002\u6b64\u5916\uff0cMehmet Okyayuz\u6559\u6388\u6279\u8bc4\u4e86\u4e00\u4e9b\u6cd5\u5f8b\u5b66\u8005\u8bd5\u56fe\u5c06\u793e\u4f1a\u80cc\u666f\u7a81\u663e\u3001\u6df7\u6dc6\u4e86\u79c1\u4eba\u4e8b\u4ef6\u548c\u516c\u5171\u4e8b\u4ef6\u7684\u754c\u9650\uff0c\u4ece\u800c\u5ffd\u89c6\u4e2a\u4eba\u9690\u79c1\u6743\u7684\u505a\u6cd5\u3002\u4ed6\u63d0\u5021\u6df1\u5165\u601d\u8003\u793e\u4f1a\u79d1\u5b66\u4e0e\u6cd5\u5f8b\u79d1\u5b66\u4e4b\u95f4\u7684\u5173\u7cfb\uff0c\u5e76\u4e3b\u5f20\u4e24\u8005\u5e94\u4fdd\u6301\u6574\u4f53\u6027\u5173\u8054\u3002\u4ed6\u8ba4\u4e3a\uff0c\u6df1\u5165\u63a2\u8ba8\u6452\u5f03\u4eba\u7c7b\u4e2d\u5fc3\u4e3b\u4e49\u7684\u7a0b\u5ea6\u662f\u5fc5\u8981\u7684\uff0c\u56e0\u4e3a\u8fd9\u79cd\u89c2\u5ff5\u4e0d\u4ec5\u4f53\u73b0\u4e86\u4eba\u7c7b\u7684\u50b2\u6162\u6001\u5ea6\uff0c\u66f4\u4e0e\u793e\u4f1a\u6597\u4e89\u7b49\u95ee\u9898\u5bc6\u5207\u76f8\u5173\u3002\u6700\u540e\uff0cMehmet Okyayuz\u6559\u6388\u63a2\u8ba8\u4e86\u6cd5\u5f8b\u5e94\u5982\u4f55\u5e94\u5bf9\u65b0\u5f62\u5f0f\u7684\u793e\u4f1a\u6d3b\u52a8\u3002\u4ed6\u8ba4\u4e3a\uff0c\u6cd5\u5f8b\u65e2\u5e94\u5f53\u5728\u65b0\u7684\u793e\u4f1a\u8303\u5f0f\u4e0b\u660e\u786e\u5176\u7acb\u573a\uff0c\u4e5f\u5e94\u9002\u5e94\u5168\u7403\u5316\u5e26\u6765\u7684\u6311\u6218\uff0c\u4ee5\u589e\u5f3a\u5176\u9002\u5e94\u529b\u548c\u6548\u529b\u3002<\/p>\n\n\n\n<p
