Legal Progress Without Judicial Change? Understanding the Limits of Workplace Sexual Harassment Protections in China

Abstract:

China has made notable legal strides in addressing workplace sexual harassment, with explicit employer responsibilities written into the Civil Code and women’s rights legislation. Yet in courtrooms, victims still face daunting barriers: strict evidentiary requirements, gender-neutral legal reasoning, and minimal recognition of power dynamics in the workplace.
Why does the law remain so reluctant to act, even after formal progress has been made?
What structural challenges lie beneath the surface of legal reform?
This talk explores these questions through feminist legal analysis and real-world judicial cases, revealing the disconnect between legal norms and courtroom practices. It also considers how employer responsibility can be reframed as a proactive duty, not just a reactive obligation—offering broader reflections on institutional reform and gender justice in transitional legal systems.
