“Renci (Mercy) Xie — Understanding the “Noncompliant Effectiveness” of Human Rights Treaties“

Abstract
This talk begins with the ongoing scholarly debate over whether international human rights law produces meaningful real-world effects. It reviews how different research approaches understand the “effectiveness” of human rights law and distinguishes between the concepts of compliance and effectiveness, arguing that the two do not necessarily coincide. Drawing on the implementation of the Convention on the Rights of Persons with Disabilities (CRPD) in China, Japan, and South Korea, the talk introduces the concept of “noncompliant effectiveness.” This concept helps illuminate the broader ways in which international human rights law can shape social practices and institutions, even in the absence of full legal compliance.
Speaker Bio:
Renci (Mercy) Xie is a disabled scholar who received her LL.M. and S.J.D. from Syracuse University College of Law on a full scholarship. She previously earned her LL.B. from Southwest University of Political Science and Law in China. Her research focuses on international human rights law, disability law, empirical legal studies, and law and society. Her work is forthcoming in the Columbia Human Rights Law Review.
